Terms of Service

RateChecky is a feedback and reputation management platform for small businesses. The Service sends automated post-appointment SMS messages to a Business User’s clients, collects star ratings and feedback, routes positive feedback toward public review platforms, routes negative feedback privately to the Business User, and provides AI-assisted tools to help the Business User respond.

You must be at least 18 years old and able to enter into a binding contract to create a RateChecky account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

As a Business User, you agree that:

• You will only submit phone numbers of individuals who are existing clients or customers of your business
• You have informed each client, at or near the time of their appointment, that they will receive a one-time SMS feedback request, and that the client has agreed to receive it
• You will not use RateChecky to send unsolicited marketing messages, promotional content, or any communication unrelated to post-appointment feedback
• You are solely responsible for honoring opt-out (STOP) requests and for complying with applicable telemarketing and messaging laws, including the Telephone Consumer Protection Act (TCPA), in your jurisdiction
• You will not upload phone numbers obtained without proper consent
• Any message you send through the recovery/reply feature (including AI-drafted messages you choose to edit and send) is sent by you, as the Business User, and you are responsible for its content

RateChecky may use AI tools to draft suggested recovery messages in response to negative feedback. These drafts are suggestions only. The Business User is solely responsible for reviewing, editing, and approving any message before it is sent. We do not guarantee the accuracy, tone, or appropriateness of AI-generated drafts, and the Business User assumes full responsibility for any message they choose to send.

• RateChecky is offered on a subscription basis (Solo and Growth plans, billed monthly or annually) with a 14-day free trial
• Subscription fees are billed in advance and are non-refundable except as required by law
• You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period
• We reserve the right to change subscription pricing with at least 30 days' notice to active subscribers
• Failure to maintain a valid payment method may result in suspension of Service access

You agree not to use RateChecky to:

• Send messages to individuals who have not agreed to receive them
• Send content that is unlawful, harassing, deceptive, or fraudulent
• Attempt to circumvent SMS opt-out mechanisms
• Reverse-engineer, resell, or sublicense the Service without our written permission
• Use the Service in a manner that violates the Telephone Consumer Protection Act, CAN-SPAM Act, or any other applicable law

We reserve the right to suspend or terminate any account found in violation of this section without refund.

RateChecky relies on third-party providers, including Twilio (SMS delivery), Supabase (infrastructure), Anthropic (AI processing), Stripe (payments), and Resend (email). Your use of RateChecky is also subject to the applicable terms of these providers where relevant. We are not responsible for outages, delays, or failures caused by third-party providers.

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied. We do not guarantee that feedback requests will be delivered, that ratings will be accurate, or that AI-generated content will be error-free or suitable for any particular purpose. We do not guarantee any specific business outcome, including review volume, rating improvement, or revenue impact.

To the maximum extent permitted by law, NSB Creative Solutions and RateChecky shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

You agree to indemnify and hold harmless NSB Creative Solutions from any claims, damages, or expenses (including reasonable legal fees) arising from your violation of these Terms, your violation of applicable law, or your misuse of client phone numbers or consent obligations under Section 3.

We may suspend or terminate your access to the Service at any time for violation of these Terms. You may terminate your account at any time through your account settings or by contacting us.

We may update these Terms from time to time. Material changes will be reflected by updating the “Effective Date” above. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the United States and the state in which NSB Creative Solutions is registered, without regard to conflict-of-law principles.
